Sex offenders and rapists could be jailed indefinitely at the discretion of the State Government under unprecedented laws that may see some locked up for life. Lenient sentences would be dealt with by the creation of "continuing detention" orders, that would apply to keep an offender behind bars after their sentence expires. The Government would initially apply for a further five years after a sentence expires and could re-apply on an ongoing basis. No limit would be placed on how many of the orders could be applied to one offender. The discretion would be based on whether there was a likelihood that the person may offend again.
